Separation

How does the separation process work for unmarried couples?

The law offers less protection when it comes to unmarried couples separating. We can advise you on your rights within the areas of property and financial claims, as well as issues with children. This may be looking at issues of residence, parental responsibility or child maintenance and contact.

If you have signed a cohabitation agreement, which is often recommended for unmarried partners, this will determine how specific assets are split. However, without this, the process will be much more complex upon the separation. This area of separation relies on property and trust law, rather than divorce law. It is important to access the advice we can give you to understand your rights and help you through the complexities.

Client Testimonials

Thank you so much for all your help over the last 18 months. I couldn’t have done it without you! You truly are wonderful and amazing at what you do and have played a huge role in supporting my family. I will miss our phone calls – I’m not going to know what to do with myself now! The happiness of my children together really sums up what we’ve been fighting for the past year and a half! Again, thank you so much, from all of us.

Mrs A

Brighton and Hove, and particularly Samantha Barker, come highly recommended. The work that Samantha puts into her client’s case is unbelievable- the preparation and attention to detail is second to none

I just wanted to take the opportunity to thank you for your services, advice and much help you gave me this year. You were very kind and patient with me Lucy and I could not have got through it without you.

Samantha Barker is extremely experienced and able. Samantha turns her hand to a wide range of children work, particularly care work achieving outstanding outcomes for a variety of clients who often present as extremely vulnerable. The team at Brighton and Hove Law have a wide breadth of practice which is second to none.

Kristina Hopper, Barrister

Thank you for all your help Sarah. I would not have got to this point on my own without your help. I appreciate everything you’ve done and the way you have always been so approachable and understanding of my situation. Without having you there this past year, I would be in a much more anxious and unhappy state of mind – and I would have felt helpless and unable to speak during the hearings.

Ms G

Thank you very much, I know I keep saying this but you have been absolutely fantastic with all your help, advice, support and energy. Thank you very much Michelle.
