How does the separation process work for unmarried couples?

The law offers less protection when it comes to unmarried couples separating. We can advise you on your rights within the areas of property and financial claims, as well as issues with children. This may be looking at issues of residence, parental responsibility or child maintenance and contact.

If you have signed a cohabitation agreement, which is often recommended for unmarried partners, this will determine how specific assets are split. However, without this, the process will be much more complex upon the separation. This area of separation relies on property and trust law, rather than divorce law.
