Judicial Separation

What is a decree of judicial separation?

For some clients, there may be reasons why divorce is not an appropriate option for them. This may be for religious reasons, but can be for any variety of reasons. If this is the case, we can assist you in obtaining a decree of judicial separation as an alternative option.

Similar to a divorce, a decree of judicial separation is a court order, but legally separated couples will still be married. The order, however, allows the couple to live apart. The processes of dividing marital assets and arrangements regarding children remain similar to that of divorce. Equally, if you later decide to proceed with a divorce, being legally separated can make these proceedings much easier when you have to divide finances and property.

What are the benefits?

Being separated from your partner, but still legally married, can benefit you both in terms of financial advantages, such as pensions and insurance plans. It also allows you to create a structure for handling legal and financial issues without the pressure of co-habitation, and the time and space may allow proceedings to progress with less emotional distress.

We can help you obtain such a decree, and advise you on the implications so that you understand your rights and can obtain a fair settlement. Contact us for more information on how we can help you.

Thank you so much for all your help over the last 18 months. I couldn’t have done it without you! You truly are wonderful and amazing at what you do and have played a huge role in supporting my family. I will miss our phone calls – I’m not going to know what to do with myself now! The happiness of my children together really sums up what we’ve been fighting for the past year and a half! Again, thank you so much, from all of us.

Mr S

Thank you for all your help through my divorce. It has truly been an incredibly stressful ordeal, much more than I ever thought it would be. What I originally thought would be a simple and even quick divorce and parting of the ways, turned into something really quite different and ugly. However, you have kept me updated through the whole procedure, explained my options to me and the process. Some of which not always clear to me so thank you for your patience. You have also been mindful of costings of which I am grateful. Your attention to detail was also very reassuring, especially at a times when I just wanted the whole thing to be over.
So again, thank you.

Mrs W – Brighton

I must say you have been amazing throughout this process and we both are most grateful. I know it has not been the most straightforward of cases, but your understanding, flexibility and patience, along with your excellent communications have made it as pain free as could be possible. I will without doubt be recommending your services.

Mr F

I had a protracted and complicated divorce and I could not have wished for a better solicitor. The divorce process and all the associated financial negotiations are complex and come at a time when you are emotionally fraught, stressed and at a low ebb. Having a solicitor who is fair, firm and practical and clearly explained the options at every stage makes such a huge difference.

Lucy enabled me to balance getting the fairest settlement with retaining a workable relationship with my ex. There were no surprise, superfluous bills or actions taken that I wasn’t 100% comfortable with, which is so important.

She was available to chat on the phone and I far preferred dealing with one solicitor, who personally knew my case, rather than going via a larger firm where you do not receive such a focused, expedited approach.

I would 100% recommend Lucy to my closest friends and family.

Ms S – Hove

If I could give an abundance of stars to rate Brighton and Hove Law I would. They have given an excellent service all round.
The care and personal attention given has been amazing. The support and understanding has been unmeasurable.
